In a stunning landmark decision, an Alabama court ruled on Tuesday that an aborted fetus is a person with legal rights.
It’s the first time in United States history that any court has recognized the legal rights of an aborted baby.
"We have already had a victory, and it was the first one of its kind, ever," Attorney Brent Helms told WAAY-TV.
The attorney added: "This is the first estate that I'm aware of that has ever been opened for an aborted baby.”
The decision comes after a man in Madison County filed a lawsuit against an abortion clinic for terminated his girlfriend’s pregnancy after he begged her to keep the baby. The baby has since become known as “Baby Roe.”
"I'm here for the men who actually want to have their baby," Ryan Magers previously told WAAY-TV.
The Madison County probate court apparently agrees with Magers that his unborn child was a person.
Magers is now clear to move forward with his lawsuit against the Alabama Women's Center and others who assisted in terminating his girlfriend’s pregnancy.
“Helms added that existing state law recognizes life begins at conception, which supports the case for Baby Roe's estate, and because of that, he believes the case could go before the state supreme court,” the local news out reported.
Whether the case could make it all the way to the United States Supreme Court is still unclear.
